Welcome to Tix Van. These Terms of Service ("Terms") govern your access to and use of the Tix Van website, mobile applications, and related services (collectively, the "Platform").


By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not access or use Tix Van.


1. About Tix Van

Tix Van is a global self-service event ticketing and experience platform that enables event organisers to create, manage, promote, and sell tickets for live and virtual events, while allowing attendees to discover and purchase tickets and explore experiences they may enjoy.


Tix Van may also provide an event marketplace where organisers can discover and connect with venues, vendors, artists, and other event-related service providers.


Tix Van provides the technology and marketplace infrastructure that supports event organisers and attendees. Unless expressly stated otherwise, Tix Van is not the organiser, promoter, sponsor, venue operator, artist, vendor, or producer of any event listed on the Platform.


The event organiser is solely responsible for the organisation, promotion, operation, safety, legality, and delivery of their event, as well as the accuracy of the information they publish on the Platform.


2. Eligibility

You must be at least 18 years old, or the legal age required in your jurisdiction to enter into a binding agreement, to create and operate an organiser account on Tix Van.


By using the Platform, you represent and warrant that you have the legal capacity and authority to enter into these Terms and comply with all applicable laws and regulations.


If you are using Tix Van on behalf of a business, organisation, or other legal entity, you represent that you have the authority to bind that entity to these Terms.


3. User Accounts

You may be required to create an account to access certain features of the Platform. You are responsible for:

  • - Providing accurate, complete, and up-to-date information.
  • - Maintaining the confidentiality and security of your login credentials.
  • - All activities conducted through your account.
  • - Ensuring that your account information remains current.
  • - Promptly notifying Tix Van of any suspected unauthorised access or security breach.

You must not create an account using false information, impersonate another person or entity, or create an account for fraudulent or unlawful purposes.

We reserve the right to suspend, restrict, or terminate accounts that violate these Terms, applicable law, or the security and integrity of the Platform.


4. Event Organiser Responsibilities

Event organisers are solely responsible for their events and agree to:

  • - Provide accurate, complete, and up-to-date event information.
  • - Clearly communicate event dates, times, locations, ticket types, prices, restrictions, and other material information.
  • - Honour all valid tickets sold through the Platform, subject to applicable laws and the published terms of the event.
  • - Obtain and maintain all licences, permits, insurance, consents, registrations, and approvals required by law.
  • - Comply with all applicable laws, regulations, industry standards, and venue requirements.
  • - Deliver events substantially as advertised.
  • - Provide appropriate arrangements for attendee safety and accessibility where required.
  • - Handle attendee enquiries, complaints, cancellations, and event-related communications professionally and promptly.
  • - Honour applicable refund and cancellation obligations.
  • - Ensure that all content, images, trademarks, music, videos, and other materials uploaded to the Platform are used lawfully.


Organisers are solely responsible for the planning, management, promotion, safety, staffing, operation, and execution of their events. Tix Van does not guarantee the quality, safety, legality, accuracy, or successful delivery of any event listed by an organiser.


5. Ticket Purchases

When purchasing tickets through Tix Van, attendees acknowledge and agree that:

  • - All purchases are subject to ticket availability.
  • - Ticket prices may include applicable taxes, booking fees, service fees, delivery fees, or other charges disclosed during checkout.
  • - A completed purchase constitutes a binding transaction between the attendee and the applicable event organiser, subject to applicable law.
  • - Ticket availability, pricing, restrictions, and conditions are determined by the event organiser unless otherwise stated.
  • - Tickets may not be duplicated, altered, counterfeited, fraudulently transferred, or used for unlawful purposes.


Each digital ticket may contain a unique QR code, barcode, ticket number, or other digital identifier. Unless otherwise specified by the organiser, a ticket identifier may only be used once for entry to the applicable event.

Tix Van may cancel, invalidate, or restrict tickets where we reasonably believe that they have been obtained fraudulently, unlawfully, duplicated, or in violation of these Terms.


6. Refunds, Cancellations, and Event Changes

Refund and cancellation policies are generally determined by the applicable event organiser and may vary between events, subject to applicable law.


If an event is cancelled, postponed, rescheduled, relocated, or materially changed, the organiser is responsible for communicating the available options to ticket holders, including refunds or alternative arrangements where applicable.


Where appropriate, Tix Van may facilitate or administer a refund process on behalf of an organiser. However, unless expressly stated otherwise, Tix Van is not responsible for funding refunds owed by event organisers.

Nothing in these Terms limits any mandatory consumer rights or remedies that cannot lawfully be excluded or restricted under applicable law.


7. Payments and Organiser Payouts

Payments made through the Platform may be processed by approved third-party payment providers.


Tix Van does not store full debit or credit card information where payment processing is handled by third-party payment providers. Payment transactions may be subject to the terms, conditions, and privacy policies of the applicable payment provider.


Tix Van is not responsible for delays, declines, reversals, chargebacks, or failures caused by payment processors, banks, card networks, financial institutions, or other third parties, except where required by applicable law.


Organiser payouts may be subject to identity verification, fraud prevention checks, chargeback reserves, transaction reviews, applicable fees, and the payout schedule communicated by Tix Van or its payment providers.


8. Prohibited Activities

Users must not:

  • - Sell, distribute, or promote fraudulent, counterfeit, stolen, or invalid tickets.
  • - Use bots, scrapers, automated purchasing systems, or other automated mechanisms without express authorisation.
  • - Attempt to bypass, disable, interfere with, or circumvent Platform security measures.
  • - Interfere with or disrupt the operation, integrity, or availability of the Platform.
  • - Upload viruses, malware, malicious code, or other harmful software.
  • - Attempt to gain unauthorised access to accounts, systems, networks, or data.
  • - Violate intellectual property, privacy, publicity, or other rights of Tix Van or third parties.
  • - Use the Platform for fraudulent, deceptive, abusive, or unlawful purposes.
  • - Provide false, misleading, or materially incomplete information.
  • - Manipulate ticket availability, pricing, reviews, event information, or Platform functionality through fraudulent means.
  • - Use the Platform in a manner that could damage Tix Van, its users, event organisers, service providers, or third parties.


Violation of these Terms may result in the immediate suspension, restriction, cancellation, or permanent termination of an account and may also result in the cancellation or invalidation of associated transactions or tickets where appropriate.


9. Intellectual Property

All Platform content, including Tix Van's name, logos, trademarks, software, designs, graphics, interfaces, text, databases, and other materials, is owned by or licensed to Tix Van and is protected by applicable intellectual property laws.


Except as expressly permitted by these Terms or applicable law, you may not copy, reproduce, modify, distribute, sell, license, publish, transmit, reverse engineer, exploit, or otherwise use any Tix Van intellectual property without prior written permission.


Nothing in these Terms grants you ownership of any Tix Van intellectual property.


10. User Content

Users retain ownership of the content they upload, submit, publish, or otherwise provide through the Platform ("User Content").


By submitting User Content to Tix Van, you grant Tix Van a worldwide, non-exclusive, royalty-free, transferable, and sublicensable licence to host, store, reproduce, display, distribute, communicate, format, and otherwise use that content as reasonably necessary to operate, provide, promote, maintain, and improve the Platform and related services.


You represent and warrant that you own or have obtained all rights, permissions, licences, and consents necessary to submit and use your User Content in accordance with these Terms.


You must not upload or publish content that is unlawful, defamatory, fraudulent, misleading, abusive, infringing, harmful, or otherwise prohibited by these Terms or applicable law.


11. Privacy

Your use of Tix Van is also governed by our Privacy Policy, which explains how we collect, use, disclose, store, and protect personal information when you use the Platform.


By using the Platform, you acknowledge that you have reviewed the Privacy Policy and understand that your information may be processed in accordance with it and applicable data protection laws.


12. Third-Party Services

The Platform may integrate with or provide access to third-party services, including payment processors, identity verification providers, marketing tools, analytics providers, cloud service providers, social media platforms, mapping services, communication providers, and other third-party technologies.


Tix Van does not control and is not responsible for the content, policies, security, availability, performance, or practices of third-party services, except to the extent required by applicable law.


Your use of third-party services may be subject to separate terms and privacy policies established by those third parties.


13. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Platform and its features are provided on an "as is" and "as available" basis.


To the extent permitted by law, Tix Van disclaims warranties, representations, and conditions, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, availability, accuracy, reliability, non-infringement, and uninterrupted or error-free operation.


Tix Van does not warrant that the Platform will always be available, secure, accurate, complete, uninterrupted, or free from errors, viruses, or other harmful components.


Nothing in these Terms excludes or limits any warranty, right, or remedy that cannot lawfully be excluded or limited.


14. Limitation of Liability

To the fullest extent permitted by applicable law, Tix Van shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, business, goodwill, data, or anticipated savings arising out of or relating to your use of the Platform, your inability to use the Platform, or your attendance at or involvement with any event.


To the fullest extent permitted by applicable law, Tix Van's total aggregate liability arising out of or relating to a particular transaction or your use of the Platform shall not exceed the amount of service fees actually paid to Tix Van in connection with the relevant transaction.


Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.


15. Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Tix Van, its directors, officers, employees, affiliates, partners, contractors, agents, and service providers from and against claims, liabilities, losses, damages, costs, and expenses, including reasonable legal fees, arising out of or relating to:

  • - Your use or misuse of the Platform.
  • - Your violation of these Terms or applicable law.
  • - Your event, event-related activities, or operation of an event.
  • - Your User Content.
  • - Your infringement or alleged infringement of third-party rights.
  • - Fraudulent, unlawful, or unauthorised activity associated with your account.


16. Suspension and Termination

We may suspend, restrict, or terminate your access to the Platform or any part of the Platform if we reasonably believe that you have violated these Terms, engaged in fraudulent or unlawful activity, created an unacceptable legal or financial risk, compromised Platform security, or otherwise acted in a manner that may harm Tix Van, its users, organisers, partners, or third parties.


Where reasonably practicable and appropriate, we may provide notice of suspension or termination. However, we may take immediate action where necessary to protect the Platform, users, third parties, or our legal and financial interests.


Termination does not affect rights or obligations that accrued before termination or provisions that by their nature should survive termination.


17. Changes to These Terms

We may update or modify these Terms from time to time to reflect changes to the Platform, our services, applicable laws, or business practices.


Where required by applicable law, we will provide appropriate notice of material changes and update the Effective Date shown at the beginning of these Terms.


Your continued use of the Platform after revised Terms become effective constitutes acceptance of the updated Terms, to the extent permitted by applicable law.


If you do not agree with the revised Terms, you should discontinue use of the Platform.


18. Governing Law and Dispute Resolution

These Terms shall be governed by and interpreted in accordance with the laws applicable to Tix Van's relevant operating jurisdiction, unless otherwise specified in a written agreement between you and Tix Van or required by applicable law.


Any disputes arising out of or relating to these Terms or your use of the Platform shall be subject to the jurisdiction of the competent courts applicable to that jurisdiction, unless applicable law provides otherwise or requires a different forum.


Nothing in this section prevents consumers from exercising mandatory rights or bringing claims in a jurisdiction where applicable law grants them that right.

By accessing or using Tix Van, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
